Wage and Hour Claims
All non-exempt employees in California have employment rights. If you are a non-exempt employee, you may have the right to:
- Get paid the minimum wage;
- Get paid overtime pay if you work more than the maximum hours;
- Take meal and rest breaks; and
- Get paid for every hour that you work, both on-the-clock and off-the-clock.
Lawyers generally refer to this area of the law as “wage and hour laws.” When wage and hour laws are not being respected, lawyers sometimes call these violations “wage theft.” This list only shows a few examples of wage and hour issues and they may vary depending on your line of work. For example, Resident Apartment Managers have special rules like “rent credit rules” or “on-call rules”, that apply specifically to them.
If you feel that your wage and hour rights are not being respected, don’t hesitate to talk to a lawyer. You may be able to seek compensation by filing a wage claim or a lawsuit against your employer. Call Abogato, LLP to speak to one of our attorneys and find out how we can help.
I BELIEVE THAT I AM A VICTIM OF WAGE THEFT BUT I AM AFRAID THAT I WILL BE FIRED IF I DO ANYTHING ABOUT IT. WHAT CAN I DO?
If you believe that your wage and hour rights are not being respected, don’t be afraid to talk to an attorney. Generally, your discussions with a lawyer are confidential. Also, it is unlawful for your employer to punish you or fire you for talking to an attorney or filing a valid claim against them. If your employer does punish you or fires you for talking to an attorney or filing a claim, you may be entitled to seek even more money in damages.
I AM UNDOCUMENTED, DO I STILL HAVE WAGE AND HOUR RIGHTS?
Yes. It doesn’t matter what your legal status is, you still have wage and hour rights and they should be respected. However, if you are undocumented, it is even more important for you to talk to an attorney to come up with a strategy of how to file a wage claim or lawsuit.
